1. Agreement to These Terms
By accessing or using Dayzy, you agree to follow these Terms of Service and any additional terms shown inside a Dayzy product, checkout flow, subscription screen, app, dashboard, or related feature. If you do not agree to these terms, do not use Dayzy.
These terms apply to My Dayzy and the Dayzy product family, including Moments, Connect, Harmony, Spark, Reflection, Timeless, and related Dayzy websites, pages, apps, dashboards, forms, subscriptions, and services that link to these terms.
2. Dayzy Products
Dayzy includes products for event pages, private circles, planning, movement, reflection, memory keeping, guest participation, subscriptions, and related digital tools. Product names, features, templates, dashboards, storage, guest tools, billing options, and availability may change as we improve the platform.
Some products may have product-specific rules, limits, checkout terms, storage limits, or feature notices. If a product-specific term conflicts with these general Terms of Service, the product-specific term controls for that feature.
3. Accounts and Information
You must be at least 18 years old to create a Dayzy account or use features that include user-generated content, messaging, calls, invitations, or shared spaces.
Before using those features, you must confirm that you are 18 or older and accept the current Terms of Service and Community Guidelines. Dayzy records the accepted policy version and time.
You may need an account to use certain Dayzy products. You are responsible for the accuracy of information you provide, the security of your login credentials, and all activity that occurs through your account, forms, pages, invitations, or dashboards.
You agree not to create accounts using false information, impersonate another person, access another user's account without permission, or interfere with another user's access to Dayzy. If you believe your account has been accessed without authorization, contact Dayzy promptly through the Contact page.
4. Acceptable Use
You may not use Dayzy to submit, upload, publish, transmit, or share unlawful, abusive, harassing, threatening, hateful, explicit, misleading, fraudulent, harmful, infringing, spammy, malicious, or unauthorized content. You also may not use Dayzy to violate another person's privacy, publicity rights, intellectual property rights, or other rights.
Moments and Connect provide Report and Block controls. Reports may hide content while it is reviewed. Blocking prevents messages, calls, and invitations in both directions. Repeated or serious violations may result in a warning, content removal, suspension, or account termination. You agree to follow the Community Guidelines whenever you interact with other people through Dayzy.
You may not interfere with Dayzy's operation, bypass security controls, scrape or harvest data without permission, reverse engineer restricted parts of the service, upload malware, overload infrastructure, manipulate forms, abuse invitations, or use Dayzy in a way that harms the platform or other users.
5. Content You Provide
You keep ownership of content you submit to Dayzy, including event details, photos, messages, notes, guest information, page copy, templates, keepsakes, profile details, and other materials you provide. You are responsible for making sure you have the rights and permissions needed to submit and share that content.
You give Dayzy permission to host, store, copy, process, display, transmit, resize, optimize, back up, and otherwise use your content as needed to provide, maintain, secure, support, and improve the products and services you choose to use.
6. Shared Pages, Invitations, and Guest Content
Some Dayzy products are designed for sharing. If you publish a page, invite guests, share a link, collect RSVPs, request uploads, or allow guest messages, people with access may view or interact with the content according to your settings and the product's available controls.
You are responsible for who you invite and what you share. Dayzy cannot control how recipients use content after they receive access, download files, take screenshots, forward links, or otherwise copy information outside the Dayzy platform.
7. Host and Guest Responsibilities
Hosts are responsible for page details, event accuracy, guest communications, uploaded content, privacy choices, and permissions for people included in a page or event. Guests are responsible for the accuracy and appropriateness of the RSVPs, photos, messages, and other content they submit.
Dayzy may remove or restrict access to content, pages, uploads, messages, or accounts when we believe they violate these terms, create risk, infringe rights, abuse the service, or conflict with product safety standards.
8. Payments and Subscriptions
Paid plans, trials, renewals, upgrades, downgrades, lifetime offers, storage limits, and subscription features are presented at checkout or inside the billing area. Payment processing may be handled by third-party providers such as Stripe.
By starting a paid plan or subscription, you authorize the applicable payment provider to charge the payment method you provide for the plan, renewal, taxes, fees, or other charges shown at checkout. Subscription plans may renew automatically unless canceled according to the cancellation options available in your account or billing portal.
9. Trials, Upgrades, and Downgrades
Dayzy may offer trials or promotional access. Trial length, features, storage, and conversion rules may vary by offer. If payment is required after a trial, access may be limited or paused if payment is not added before the trial ends.
If you upgrade, new features or higher limits may become available after the change is processed. If you downgrade, features and limits may decrease. For example, media storage may decrease from a Professional limit to a Personal limit, and additional uploads may be blocked if your account is over the downgraded limit until you reduce usage or upgrade again.
10. Cancellations and Refunds
You may cancel a subscription through the available billing tools or by contacting support when self-service billing is not available. Cancellation affects future renewals unless the checkout or billing flow states otherwise. Access may continue until the end of the current billing period, depending on the plan and provider settings.
Refunds are not guaranteed unless required by law or stated in a specific offer. If you believe a charge is incorrect, contact Dayzy with the account email, plan, date, and any payment details needed to review the request.
11. Storage and File Uploads
Dayzy may set storage limits, file size limits, file type limits, upload limits, or media processing rules by plan or product. We may optimize, resize, reject, remove, or restrict files to protect performance, safety, storage, and product reliability.
If your account exceeds a plan limit, Dayzy may block additional uploads until you delete content, reduce usage, upgrade, or otherwise bring the account within the allowed limit. You are responsible for keeping backup copies of important files outside Dayzy.
12. Third-Party Services
Dayzy may link to, embed, or integrate with third-party services such as payment processors, hosting providers, analytics tools, email providers, map tools, storage providers, print partners, app stores, or authentication services. Their terms and privacy practices apply separately from Dayzy.
We are not responsible for third-party services, content, websites, policies, outages, fees, or actions. If you use a third-party service through Dayzy, you may also be bound by that provider's terms.
13. Intellectual Property
Dayzy, My Dayzy, product names, logos, designs, layouts, templates, software, code, text, graphics, icons, interfaces, and related materials are owned by Dayzy or its licensors, except for content submitted by users or third parties. These terms do not transfer ownership of Dayzy intellectual property to you.
You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from Dayzy materials except as allowed by the product, these terms, or written permission from Dayzy.
14. Feedback and Ideas
If you send Dayzy feedback, ideas, suggestions, feature requests, designs, or other recommendations, you allow Dayzy to use them without restriction or compensation. This helps us improve products without creating ownership disputes over ideas submitted voluntarily.
15. Privacy
Dayzy's handling of personal information is described in the Privacy Policy. By using Dayzy, you acknowledge that Dayzy may collect, use, store, and share information as described in that policy and related product notices.
16. Service Changes and Availability
We may update, modify, suspend, limit, or discontinue parts of Dayzy when needed for product changes, maintenance, legal reasons, security, business needs, technical constraints, or operational reasons. We work to keep Dayzy reliable, but we do not guarantee that every feature will always be available.
We may also change plan features, product names, templates, page designs, limits, and supported workflows over time. If a change materially affects a paid service, we will try to provide reasonable notice where appropriate.
17. Account Suspension or Termination
We may suspend, restrict, or terminate access to Dayzy if we believe you violated these terms, created risk, failed to pay required charges, abused the service, infringed rights, created security concerns, or used Dayzy in a way that harms other users or the platform.
You may stop using Dayzy at any time. Some information may remain in backups, records, billing systems, logs, or shared pages for a period of time as described in the Privacy Policy or as needed for legitimate operational, legal, or security reasons.
18. No Professional Advice
Dayzy may help organize events, memories, routines, goals, notes, reflections, or family information, but it does not provide legal, medical, financial, therapeutic, safety, or professional advice. You are responsible for decisions you make based on your own information and circumstances.
19. No Warranty
Dayzy is provided "as is" and "as available." We work to keep the experience reliable, useful, and secure, but we do not guarantee uninterrupted operation, error-free service, perfect security, permanent storage, or that every feature will meet your expectations.
20. Limitation of Liability
To the fullest extent allowed by law, Dayzy is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost content, business interruption, or loss of goodwill related to your use of Dayzy.
To the fullest extent allowed by law, Dayzy's total liability for claims related to the service is limited to the amount you paid to Dayzy for the service giving rise to the claim during the twelve months before the claim, or one hundred dollars if you did not pay Dayzy for that service.
21. Indemnification
You agree to defend, indemnify, and hold Dayzy harmless from claims, damages, losses, liabilities, costs, and expenses arising from your content, your use of Dayzy, your violation of these terms, your violation of law, or your violation of another person's rights.
22. Governing Law
These terms are governed by the laws of the United States and the applicable laws of the state where Dayzy operates, without regard to conflict of law principles. Some jurisdictions may give you additional rights that cannot be waived by contract.
23. Changes to These Terms
We may update these Terms of Service as Dayzy changes, as products are added, or as legal and operational requirements evolve. The updated date above shows when the latest version was posted. Continued use of Dayzy after changes become effective means you accept the updated terms.
